(1)(a) A person, whether an adult or juvenile, is guilty of the crime of unlawful possession of a firearm in the first degree, if the person owns, has in his or her possession, or has in his or her control any firearm after having previously been convicted or found not guilty by reason of insanity in this state or elsewhere of any serious offense as defined in this chapter. (F) Is presently subject to an order under ORS 426.133 prohibiting the person from purchasing or possessing a firearm; (G) Has been found guilty except for insanity under ORS 161.295 of a felony; or (H) The possession of the firearm by the person is prohibited under ORS … firearm or dang. (1) Except as otherwise provided in this section or ORS 166.260, 166.270, 166.274, 166.291, 166.292 or 166.410 to 166.470 or section 5, chapter 826, Oregon Laws 2009, a person commits the crime of unlawful possession of a firearm … in public building; (2)(a)(c) – intent poss. ORS 166.250 Unlawful possession of firearms (UPFA). (5) Unlawful possession of a firearm is a Class A misdemeanor. Section 166.272. 18: 21: ORS 166.470: Oregon law prohibits any person from intentionally selling, delivering, or otherwise transferring any firearm to anyone under 18 years of age (ORS 166.470(1)(a)), except: A parent or guardian, or another person with the consent of the parent or guardian, may transfer a firearm other than a handgun to a minor. 4 Criminal Procedure, Crimes. A person prohibited from possessing or purchasing a firearm under this measure may file a petition with a circuit court for relief from the prohibition. ORS 138.060. Section 166.260. Persons not affected by ORS 166.250. Possession of weapons by certain felons. (1) It is unlawful for a person to knowingly possess a firearm or ammunition if: (a) The person is the subject of a court order that: (A)(i) Was issued or continued after a hearing for which the person had actual notice and during the course of which the person had an opportunity to be heard; or (1) Except as otherwise provided in this section or ORS 166.260, 166.270, 166.274, 166.291, 166.292 or 166.410 to 166.470 or section 5, chapter 826, Oregon Laws 2009, a person commits the crime of unlawful possession of a firearm if the person knowingly: (a) Carries any firearm … (6) A person in possession of a firearm or ammunition in violation of ORS 166.255 (1)(b) or (c) may not be prosecuted under ORS 166.250 if: (a) The person is in possession of a court order described in subsection (1) of this section issued within the previous 24 hours; (b) The firearm is unloaded; and Defendant was charged with supplying contraband, ORS 162.185, after marijuana was discovered in his possession when he was being booked after being arrested for unlawful possession of a firearm, ORS 166.250. Section 166.255. Unlawful possession of firearms. Minimum age to purchase firearms. Section 166.270. A person prohibited from possessing a firearm under this measure may be charged with unlawful possession of a firearm, a Class A misdemeanor. The state appeals from a pretrial order suppressing evidence and dismissing this case at the state's request. SECTION 4.
